AIVIA INC., together with our affiliates and subsidiaries (“we,” “our”, “us”), respect your privacy and are committed to protecting it by complying with this Privacy Policy (the “Policy”).
This Policy describes how COMMUNIKIT (the “App”), collects, uses, discloses, and safeguards the information of app users (“you”) when you use our mobile application, related software, alerts, and communication features (collectively, the “Services”).
We are committed to protecting your privacy and ensuring transparency about our data practices and we will only use your personal information in accordance with this policy unless otherwise required by applicable law. By using the Services, you agree to the terms of this Policy. If you do not agree with this Policy, we recommend that you discontinue your use of the Services.
1. Information We Collect
We take steps to ensure that the data and personal information that we collect is adequate, relevant, not excessive, used for limited purposes, and is only collected when such data and personal information is necessary to operate, maintain, and improve the Services.
The data and personal information we collect is obtained in the following manner
1.1. Information You Provide Directly
- Account Information: such as your username, phone number, and email address.
- Preferences: such as your username, phone number, and email address.
- Support Requests: such as your username, phone number, and email address.
- Other Information Provided in the App: such as your username, phone number, and email address.
1.2. Information Collected Automatically
When you use the Services, we automatically collect certain technical and usage data, including:
- Device Information: device model, operating system version, hardware identifiers, and system settings.
- Log Data: IP address, app activity, error reports, crash logs, and diagnostic data.
- Usage Data: which features you use, how often you access the app, and your notification interaction history.
Technologies we use for this automatic data collection may include mobile cookies and web beacons.
1.3. Information We Do Not Collect

- We do not collect sensitive personal data such as biometric identifiers, payment details, or government-issued IDs, unless you expressly provide such information for a specific feature on the App.

When you use the App or its content, certain third parties collect information about you or your device. These third parties may include:
- Advertisers, ad networks, and ad servers.
- Analytics companies.
- Your mobile device manufacturer.

2. How we use your information
We use the collected information only for legitimate purposes necessary to provide and improve the Services. Uses include:
- Service Delivery: to provide you with the App and its contents, operating the app, sending alerts, notifications, and communications.
- Personalization: tailoring features to your preferences, such as your notification opt-in/out choices and to provide you with information, products or services that you request from us.
- Updates & Maintenance: providing software updates, security patches, and feature enhancements, as well as to notify you when App updates are available, and of changes to any products or services we offer or provide though it.
- Performance Monitoring: analyzing technical and usage data to improve app stability and reliability, or to improve customer relationships and experiences
- Fraud & Security: detecting, preventing, and addressing unauthorized access or misuse.
- Legal Obligations: complying with applicable laws and responding to lawful requests, and to carry out our obligations and enforce our rights in any contracts with you, including for billing and collection.
3. How we share your information
We respect your privacy and handle your information responsibly. We do not sell, rent, or trade your personal information to third parties
We may share information under the following limited circumstances:
3.1. Service Providers
We may share information with trusted third-party providers who help us operate and deliver the Services, such as:
- Cloud hosting providers;
- SMS, email, or telecommunications providers; and
- Analytics and crash reporting services.
These providers are contractually required to safeguard your information and use it only as instructed.
3.2. Legal Requirements
We may disclose your information if required to do so by applicable law, regulation, legal process, or governmental request, as well as to enforce our rights arising from any contracts between you and us, including the App, and including for billing and collection purposes.
3.3. Business Transfers
If our company undergoes a merger, acquisition, restructuring, or sale of assets, your information may be transferred as part of that transaction. Additionally, we may disclose personal information that we collect or you provide to our subsidiaries and affiliates in the ordinary course of business.
4. Notifications and Alerts
4.1. Opt-In and Opt-Out
You may enable or disable notifications and alerts at any time via your device or app settings.
4.2. Mandatory Communications
Certain service-related communications (such as critical system updates or terms changes) cannot be disabled and may be sent to you even if you disable optional notifications on your device or your device is set to “Silent” or “Do Not Disturb” modes.
4.3. Delivery Methods and Costs
Communication may be delivered via:
- In-app alerts;
- Push notifications;
- SMS or phone calls; and
- Email.
Please be aware that SMS or phone calls may incur fees charged by your carrier. In such case, these costs are your responsibility and we shall not be liable for any such costs for any reason.

We retain your information only as long as necessary to fulfill the purposes for which it was collected, including but not limited to:
- Provide the Services;
- Comply with legal, accounting, reporting and regulatory obligations; or
- Resolve disputes and enforce agreements.
If you delete your account or stop using the Services, we will delete or anonymize your personal data within a reasonable time, except where retention is required by law.

The security of your personal information is very important to us and we implement industry-standard security measures to protect your information, including but not limited to:
- Encryption of communications where appropriate;
- Secure servers and firewalls;
- Access controls to limit data handling to authorized personnel only.
However, no system or transmission method is completely secure. The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of our App, you are responsible for keeping it confidential. We ask you not to share your password with anyone.
Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the App. You acknowledge and agree that you use the Services at your own risk, and you are responsible for keeping your device and App software up to date. We are not responsible for circumvention of any App privacy settings or security measures.
7. Children’s privacy
The Services are not directed at children under the age of 13 and no one under age 13 may provide any personal information to or on the App. We do not knowingly collect personal information from children under the age of 13. If you are under 13, do not use or provide any information on this App, make any purchases through the App, use any of the interactive or public comment features of this App, or provide any information about yourself to us, including your name, address, telephone number, email address, or any user name you may use. If we discover that a child has provided us with personal data, we will delete that information promptly.
8. International users
If you access the Services from outside of Canada, please note that your information may be transferred to, stored, and processed in countries other than your own. This may include use of servers located outside of Canada. Privacy laws in these jurisdictions may not provide the same level of protection as those in your home country. By using the Services from outside of Canada, you consent to such transfers and processing.

To the maximum extent permitted by law, we are not responsible for:
- Unauthorized access to your data by third parties;
- Failures in notification delivery due to your device settings, carrier delays, or third-party providers; or
- Losses or damages resulting from reliance on alerts.
You acknowledge that no system is perfectly secure and accept responsibility for using the Services at your own risk.
